Terms of use

1.The agreement

These terms are a contract between you and Dímelo ("Dímelo", "we", "us") covering the Dímelo mobile app, the website at trydimelo.com, and everything we provide through them (together, the "Service"). By creating an account or using the Service you agree to them. If you do not agree, do not use the Service.

How we handle your data is covered separately by our privacy policy, which forms part of these terms.

2.Beta software

Dímelo is in beta. That means it is unfinished by design: features will change, be added, or be removed; the course content is still being written and corrected; and the Service may be unavailable, slow, or buggy at times. We may need to reset or migrate parts of your learning data as the product evolves, and we will try to warn you first when we do.

The Service is currently free. If we introduce paid plans later, we will tell you clearly what costs money and what does not before you are asked to pay anything, and payment terms will be added here.

3.Your account

• You must be at least 13 years old to use the Service. If your country sets a higher age for agreeing to terms like these without a parent, that higher age applies.
• Give us an email address you control. We use it to sign you in and to send password-reset codes; we cannot recover an account whose email you have lost access to.
• You are responsible for what happens under your account. Keep your password private, and tell us if you think someone else has used it.
• One account per person. Do not share accounts or create accounts for other people.
• You can delete your account at any time from Settings. Deletion is immediate and permanent.

4.Acceptable use

Use the Service to learn Spanish. Do not:

• try to break into, overload, probe or interfere with the Service or the accounts of others;
• copy, scrape, download in bulk, republish or resell the course content, audio, exercises or explanations;
• reverse engineer the app or use automated tools to extract content or to drive the AI features;
• use the tutor or conversation features to generate content that is illegal, harassing, hateful, sexual or that targets a real person;
• try to make the AI features act outside their purpose, or use them as a general-purpose chatbot at scale;
• impersonate anyone or misrepresent your connection with us.

We may suspend or close accounts that break these rules, and we may remove content that does.

5.AI features

Much of Dímelo is powered by third-party AI models: marking your answers, explaining mistakes, translating, talking with you as a tutor, and transcribing your speech. This output is generated automatically and is not reviewed by a person before you see it.

AI output can be wrong: a correct answer may be marked wrong, a wrong one right, an explanation may be inaccurate, and a transcript may mishear you. We work hard to keep this rare, and you can report anything that looks off with the feedback link in Settings. But you use the AI features on the understanding that they are a study aid, not a certified teacher, examiner or translator, and you should not rely on them where accuracy matters (for example official correspondence, legal, medical or financial matters).

What you type and say to the AI features is sent to the providers named in our privacy policy. Do not put passwords, payment details or other people's private information into the tutor.

6.Content and ownership

Ours. The course, lessons, exercises, explanations, audio, artwork, software and design of the Service belong to Dímelo or our licensors and are protected by copyright and other laws. We grant you a personal, non-transferable, non-exclusive, revocable licence to use them through the app for your own learning. Nothing here transfers ownership to you.

Yours. You own what you write and say in the Service. To operate it we need permission to store, process, transcribe, mark, and display your content back to you, and to send it to our AI providers for that purpose; you grant us that licence for as long as your content is in the Service. We may also use your content, stripped of anything identifying you, to improve the course and its marking. We will not publish your content or use it in marketing without asking you.

Feedback. If you send us suggestions or bug reports, we can use them freely without owing you anything. We appreciate them.

Not affiliated. Dímelo aligns its course with the CEFR levels (A1–B2) and the DELE exam format. It is not affiliated with, endorsed by, or an official preparation product of the Instituto Cervantes, the Council of Europe, or any examining body.

7.App stores

If you downloaded the app from the Apple App Store or Google Play, their terms also apply to the download. Apple and Google are not parties to these terms and have no obligation to provide support or maintenance for the app; those are our responsibility. For iOS, Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You confirm you are not in a country under a US government embargo or on any US government list of prohibited or restricted parties.

8.Ending things

You can stop using the Service at any time, and delete your account from Settings. We can suspend or end your access if you break these terms, if we are required to by law, or if we discontinue the Service. If we discontinue it or any significant part of it we will give reasonable notice where we can, so you have the chance to export your data first.

Sections that by their nature should survive (ownership, disclaimers, liability, governing law) continue to apply after your account is closed.

9.No warranty

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including that it will be uninterrupted, error-free, secure, or that its content and AI output will be accurate or fit for a particular purpose. Learning outcomes depend on you; we do not promise that you will pass any exam or reach any level.

Some jurisdictions do not allow certain warranties to be excluded. Nothing in these terms limits rights you have under consumer law that cannot be excluded.

10.Limitation of liability

To the fullest extent the law allows, Dímelo will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, profits or goodwill, arising from your use of or inability to use the Service, including from AI output that is inaccurate. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the twelve months before the claim and US$50.

Nothing in these terms excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded.

11.Your responsibility to us

If someone brings a claim against Dímelo because of content you put into the Service or because you broke these terms, you agree to cover the reasonable costs and losses that result.

12.Disputes

If you have a problem with the Service, email hello@trydimelo.com first; most problems are quicker to fix that way. If you are a consumer, you keep the protection of the mandatory laws of the country you live in and may bring a claim there.

13.Changes to these terms

We will update these terms as the product grows out of beta. When we do, we update the date at the top and, for changes that materially affect you, tell you in the app or by email before they take effect. Continuing to use the Service after that means you accept the new terms. If you do not, delete your account.

If any part of these terms is found unenforceable, the rest still applies. Our not enforcing a term is not a waiver of it. These terms, with the privacy policy, are the whole agreement between us about the Service.
